Gems Copyright and Intellectual Property Policy
Effective date: 11 October 2026
SVG Gems respects the intellectual property rights of others and expects Members to do the same. This policy explains how to tell us about Content on Gems that you believe infringes your copyright, trade mark or other intellectual property rights, and how Members can respond. It forms part of the Gems Terms of Service.
1. What you may post
You may post only Content that you created yourself or that you have permission to share. Before posting a photograph, check that you took it or that its owner has agreed. Using a logo, brand name or trade mark in a way that suggests a connection that does not exist is not allowed.
2. Reporting infringement
2.1 If you believe that Content on Gems infringes your copyright or other intellectual property right, please send a written notice to hello@svggems.com with "Copyright notice" in the subject line, containing:
- your full name, postal address, telephone number and email address;
- a description of the copyrighted work, trade mark or other right you claim has been infringed;
- a description of where the infringing Content appears on Gems, with enough detail for us to find it, such as a link or the name of the place and post;
- a statement that you have a good-faith belief that the use is not authorised by the rights owner, its agent or the law;
- a statement that the information in your notice is accurate and that you are the rights owner or authorised to act on the owner's behalf; and
- your physical or electronic signature.
2.2 Notices that do not contain this information may not be actioned. Knowingly making a false or misleading notice may expose you to legal liability.
3. What we do
3.1 On receipt of a valid notice, we will act expeditiously to remove or disable access to the Content concerned, and will notify the Member who posted it, including the name of the complainant and the substance of the notice, where it is lawful to do so.
3.2 We are not in a position to decide disputes about ownership or licensing. Removing Content in response to a notice is not a finding that it was infringing.
4. Counter-notice
4.1 If your Content was removed and you believe this was a mistake, or that you have the right to use it, you may send a counter-notice to hello@svggems.com with "Counter-notice" in the subject line, containing:
- your full name, postal address, telephone number and email address;
- a description of the Content removed and where it appeared;
- a statement that you have a good-faith belief that the Content was removed as a result of a mistake or misidentification;
- your consent to the jurisdiction of the courts of St Vincent and the Grenadines, and to accept service of proceedings from the person who sent the original notice; and
- your physical or electronic signature.
4.2 We may send the counter-notice to the original complainant. If the complainant does not tell us within 14 days that they have started legal proceedings, we may restore the Content at our discretion.
5. Repeat infringers
We will terminate, in appropriate circumstances, the Accounts of Members who repeatedly infringe the intellectual property rights of others.
6. Our own intellectual property
The Gems and SVG Gems names and logos, the design of the app and website, the map's compilation and databases, and our original text, graphics and software are protected by intellectual property law. You may not use them except as permitted by the Terms of Service. To ask for permission, for example for press or partnership use of our logo, write to hello@svggems.com.
7. Third-party data and attributions
Gems uses data and content licensed from third parties, which remain subject to their own licences, including Google Maps, OpenStreetMap data (© OpenStreetMap contributors, Open Database Licence) and Open-Meteo weather data (Creative Commons Attribution 4.0). Attributions are set out in the Terms of Service.
